1. Introduction; Scope
This Privacy Policy (“Policy”) applies to personal and health information collected by Evolve Wellness Group, LLC(“Evolve,” “we,” “us,” or “our”) through our websites, mobile applications, telemedicine portals, patient portals, appointment scheduling systems, and related services (collectively, the “Services”). This Policy describes how we collect, use, disclose, safeguard, and retain information, including protected health information (“PHI”) as defined under the U.S. Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations (45 C.F.R. Parts 160–164). This Policy is incorporated by reference into any agreements between you and Evolve.
2. Definitions
a. “Personal Information” means information that identifies an individual, including name, address, email, telephone, and billing information.
b. “PHI” means individually identifiable health information held or transmitted by Evolve in any form that is created or received in the course of providing healthcare services, and that relates to the past, present, or future physical or mental health condition, provision of healthcare, or payment for healthcare. PHI is subject to specific HIPAA privacy and security requirements.
3. Information We Collect
We may collect the following categories of information:
3.1 Personal Information You Provide: name, address, email, telephone, date of birth, emergency contact, billing and insurance information, medical history, symptoms, clinical data, prescription and treatment information.
3.2 Electronic Identifiers and Usage Data: IP address, device identifiers, browser type, pages visited, session duration, and similar analytics.
3.3 Communications Data: messages, emails, voicemails, and other communications to and from Evolve.
3.4 Cookies and Tracking Technologies: We may use cookies, pixel tags, and similar technologies to authenticate users, improve the Services, and analyze usage patterns.
4. How Information Is Used
We use information to:
a. Provide, coordinate, and manage telemedicine and related healthcare services.
b. Process appointments, prescriptions, lab orders, and follow-up care.
c. Communicate with you regarding treatment, payment, and administrative matters.
d. Improve and personalize the Services; perform analytics; maintain and secure systems.
e. Comply with legal, regulatory, and accreditation requirements, including HIPAA.
5. HIPAA Compliance and Use/Disclosure of PHI
Evolve is a HIPAA-covered entity. We will use and disclose PHI as permitted or required by HIPAA, including:
a. For treatment, payment, and healthcare operations without patient authorization.
b. To individuals or their personal representatives as required by law.
c. To public health authorities, law enforcement, or other entities when mandated by law.
d. For research where permitted under HIPAA and applicable law, subject to safeguards and/or patient authorization.
We require all business associates (third parties handling PHI on our behalf, such as billing agents or cloud service providers) to enter into a Business Associate Agreement (BAA) that mandates HIPAA compliance.
6. Patient Rights
Under HIPAA and applicable state law, patients have rights regarding their PHI, including the right to:
a. Access and obtain a copy of their PHI.
b. Request amendments to PHI.
c. Receive an accounting of disclosures of PHI.
d. Request restrictions on certain uses and disclosures of PHI.
e. Request confidential communications.
f. Obtain a copy of Evolve’s Notice of Privacy Practices upon request.

7. Security
We maintain administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of Personal Information and PHI, including encryption, access controls, secure passwords, and regular risk assessments consistent with HIPAA’s Privacy and Security Rules.
8. Third-Party Services and Links
The Services may integrate or link to third-party vendors (e.g., analytics, teleconferencing, payment processors). Such vendors may collect data about you on our behalf, and may have their own privacy policies. We require that third-party vendors handling PHI enter into appropriate agreements (e.g., BAAs) requiring HIPAA compliance.
9. Data Retention
We retain Personal Information and PHI only as long as necessary to fulfill the purposes for which it was collected, to meet legal, regulatory, and contractual obligations, and to resolve disputes.
10. Minors
Our Services are not directed to individuals under 18. We do not knowingly collect Personal Information or PHI from minors without lawful consent.
11. Changes to This Policy
We may modify this Policy to reflect changes in legal requirements or our practices. Material changes will be posted with a revised effective date. Your continued use of the Services after such changes indicates your acceptance.
